Welcome to Kolor Drops (“Kolor Drops,” “we,” “us,” or “our”). We operate this online store and website, including all related information, content, features, tools, products, and services (the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (“Terms”), together with our Privacy Policy, Refund Policy, and Shipping Policy, describe your rights and responsibilities when using our Services.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our related policies. If you do not agree, please do not use the Services.

1) Access & Account

  • You confirm you are at least the age of majority in your place of residence (or have consent from a parent/guardian) and authorize any minor dependents using devices you own/manage.

  • You agree to provide accurate, current, and complete information (e.g., email, billing, payment, and shipping details).

  • You are responsible for safeguarding your account credentials and all activity that occurs under your account.

2) Our Products (Handmade Notes)

  • We strive to describe and photograph products accurately, but colors, textures, and materials may vary by screen/display and due to the handmade nature of many items.

  • Earrings & Headwear: All earrings and hats are handmade. Natural variation is part of their uniqueness.

  • We do not guarantee any product will meet your exact expectations or appear precisely as shown online.

  • Product descriptions, pricing, and availability may change without notice. We may discontinue or limit products at our discretion.

3) Orders

  • Your order is an offer to purchase; we may accept or decline at our discretion. Payment must be received before order confirmation.

  • Please review your order carefully before checkout (item, size, color, quantity, and address).

  • Order changes/cancellations: If you spot an error, contact info@kolordrops.com within 24 hours. We’ll do our best before processing begins, but changes are not guaranteed once production or fulfillment starts.

  • Your purchases are subject to our Refund Policy.

  • You represent that purchases are for personal/household use and not for resale.

4) Prices, Taxes & Billing

  • Prices, discounts, and promotions may change without notice. The price at checkout/confirmation applies. Unless stated otherwise, prices exclude taxes, shipping, handling, customs/duties, and import fees.

  • You agree to provide current, complete billing information and authorize us (and our payment processors) to charge your payment method for all purchases.

5) Shipping, Delivery & Risk of Loss

  • Delivery times are estimates, not guarantees. We are not responsible for carrier delays, customs processing, weather, or events beyond our control.

  • Title and risk of loss pass to you when the order is transferred to the carrier.

6) Refunds, Replacements & Exchanges (Summary)

  • Please review our Refund Policy for full terms.

  • Earrings & Headwear: Due to hygiene and the handmade nature of our designs, all sales are final. If your earrings or headwear arrive broken or damaged, contact info@kolordrops.com within 7 days. We’ll gladly replacewhenever possible; handmade replacements may take time and may not be exact matches, but we’ll do our best to recreate the piece with care.

  • Apparel: All sales are final unless an item arrives defective or incorrect; we may replace the item or refund if replacement is not possible.

  • Sale/clearance/limited edition items are final sale.

7) Intellectual Property

  • All content on the Services—text, graphics, images, logos, videos, layouts, and trademarks—is owned by Kolor Drops, its affiliates, or licensors, and protected by applicable IP laws.

  • You may use the Services for personal, non-commercial purposes only. Any unauthorized copy, reproduction, distribution, modification, or derivative use is prohibited.

  • “Shopify” and related marks are the property of Shopify Inc. Other third-party marks belong to their respective owners.

8) Optional Tools & Third-Party Links

  • You may access third-party tools and features provided “as is” and “as available.” We do not control or endorse them and assume no liability for their use. Use is at your own risk and subject to third-party terms.

  • Our site may contain links to third-party sites. We are not responsible for their content, policies, or practices.

9) Relationship with Shopify

  • Our Services are powered by Shopify. Purchases made through our store are between you and Kolor Drops, not Shopify.

  • You acknowledge Shopify is not responsible for your transactions and release Shopify and its affiliates from claims related to your purchases.

10) Privacy

  • Personal information collected through the Services is governed by our Privacy Policy and Shopify’s privacy practices.

  • Because our store is hosted by Shopify, your information may be transferred to Shopify and its service providers (including outside your country) to operate and improve the Services.

11) User Content & Feedback

  • If you submit reviews, photos, ideas, or feedback, you grant us a perpetual, worldwide, royalty-free license to use, reproduce, adapt, publish, and display such content for business and marketing purposes.

  • You represent you own or have rights to the content and that it does not infringe others’ rights.

12) Errors, Inaccuracies & Omissions

  • Occasionally our site may contain errors or omissions (e.g., pricing, availability, descriptions). We may correct, update, or cancel orders impacted by such inaccuracies at any time, without prior notice.

13) Prohibited Uses

You agree not to use the Services to:

  • Infringe intellectual property;

  • Transmit malware, spam, or malicious code;

  • Scrape, crawl, or interfere with site security or functionality;

    We may suspend or terminate access for prohibited conduct.

  • If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

19) Waiver & Entire Agreement

  • Our failure to enforce any right is not a waiver. These Terms, together with our posted policies, are the entire agreement between you and us regarding the Services.

20) Assignment

  • You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer these Terms without notice.

21) Governing Law & Jurisdiction

  • These Terms and any related dispute will be governed by the laws of the United States of America.

  • You and Kolor Drops consent to the exclusive jurisdiction of U.S. federal or state courts for any dispute arising from or relating to the Services or these Terms.

22) Headings

  • Headings are for convenience only and do not affect interpretation.

23) Changes to These Terms

  • We may update or revise these Terms from time to time. Updates will be posted on this page with a “Last Updated” date. Your continued use of the Services after changes are posted means you accept the revised Terms.
